Valerie Morse has been successful in having a conviction for burning the New Zealand flag set aside. The District Court judge held that disruption to public order was not a necessary element in deciding whether behaviour was offensive under the
Summary Offences Act 1981, s 4(1)(a). However, the Supreme Court held that disruption to public order was a necessary element. The Supreme Court decided it was inappropriate to retry the case. Read more
